The only basis for divorce is the ‘irretrievable breakdown of marriage’ and a separation of at least 12 months (although there are certain circumstances in which you may be separated while living in the same residence).
Either party may initiate divorce proceedings, or you may submit a joint application. The person who applies for the divorce will pay for it, and the other party will not have to do anything except sign the relevant forms.
There is ‘no fault’ attributed in a divorce.
A divorce is a legally separate undertaking to matters such as the distribution of property or children's matters. Obtaining a divorce is not a prerequisite to finalising the settlement of property or child welfare matters. However, the court must be satisfied that proper arrangements have been made for the care of children under the age of 18.
A delay of approximately 3 months occurs between the date of filing and the date of the divorce hearing, at which a ‘decree nisi’ is granted. One month later this becomes a ‘decree absolute’, which is required before you are able to re-marry.
